Consolidation Watch: Property taxes

As the vote on the “Metropolitan Charter” draws closer, we all need to watch for misleading information! Just as a recent example, I received an e-mail from an organization that apparently was organized to support consolidation. This was before the Charter was even written, so it appears the objective was not a good Charter, but just to support consolidation. One of the big claims is that “consolidation” in Nashville (which took place in 1962) is the reason Nashville has lower property taxes!!!! No other criteria was apparently reviewed, such as Nashville having a lot larger sales tax/business tax base, Nashville being the State Capital, motel tax revenues etc., just that “consolidation” was the answer! The difference between the "Urban" tax rate in Nashville (an "urban tax rate" is the rate that is imposed in the Nashville "urban services" district) and the "general" tax rate (the rate charged in suburbs etc.) is only .53 cents! It appears that the suburbs in Davidson County are subsidizing the urban services in Nashville and I strongly expect that is what will happen here! It was also stated that “property taxes would probably decrease” under the new Charter. This is simply not true for the suburbs and the rural areas. It may be true for the City of Memphis, although I have not seen any plan on how the over one billion dollars in "unfunded liabilities" for retirement costs for the current City of Memphis is going to be funded if the Charter is adopted. In any event, the final Charter is not yet written. The claim is also repeated in numerous documents. Q. Will a new metro government lower my taxes? A. Judging from our peer cities, like Nashville, the tax rate could fluctuate and ultimately drop. Right now the cumulative tax rate in Memphis and Shelby County is the highest in the state at $7.21. That's almost double the tax rate of the Nashville/Davidson County Metro Government. Our tax rate is so high partly because of duplicated services in the dual government system that waste taxpayer dollars. By eliminating waste, a metro government could get a better handle on our ever-growing tax rate. To force efficiency on day one, the new government would operate under a three-year property tax freeze. Property taxes could go down, but could not go up during this time.

Gather the children, decorate your family and your favorite parade "floats" and participate in the Children's 14th Annual Independence Day Parade in celebration of our Great Nation's birth. The parade route is less than one mile. Non-motorized vehicles of all descriptions are invited to join the parade, including bikes, tricycles, wagons, and strollers. (There is an exception to the non-motorized rule; children's electric, battery operated jeeps and other vehicles are allowed. Gasoline engines are prohibited.)

The Shelby County Sheriff's Traffic Division has provided motorized escort and traffic control in past years. We look forward to their participation again this year on July 3. The children have enjoyed seeing the Deputies, especially those on motorcycles.

Trustmark will have refreshments and gifts. For those coming in from other parts of Lakeland, park on Leeward Slopes and Cutter Cove. Windward slopes residents and guests will gather at 9:45 am in the street in front of 9677 Cutter Lane.

NEW YARD WASTE PICK-UP SCHEDULE

FOR RESIDENTS WHO HAVE MONDAY TRASH COLLECTION

Effective July 12, 2010, the Wednesday yard waste pick- up route will be split and will include a new Tuesday pick up route. The new pick-up schedule is for those residents in the Monday trash collection area north of I-40 east of Garner Lake and south of Hwy 70. All residents affected by this change will be notified by All Star.

Have a Safe Trip

Whether it’s a weekend get away or the vacation of a lifetime, a little time away from home can be full of fun and adventure. For some families and business travelers, however, the prospect of traveling in the wake of 9/11 might still seem a little frightening. The good news is that with a little extra planning and attention to detail, vacations and business trips can still be safe, enjoyable and productive.

In fact, governmental agencies have focused a lot of attention on travel safety since the tragic events of September 11, 2001. New security procedures at airports and on planes have made air travel even safer. The travel and tourism industry has also strengthened programs to ensure that people can enjoy road trips, hotel stays and destination visits with confidence.

As always in these times, it makes sense to be alert and observant. We should always be aware of our surroundings and report any suspicious activities to local authorities. In selecting routes and destinations, we should avoid locations where there is active hostility; contact the U.S. State department if you’re not sure of the threat level in foreign countries. It is always wise to be knowledgeable about your destination, to have planned your trip carefully, and to be courteous guests when we travel.

Based on recent events such as the volcano eruptions that occurred in Iceland, travel can be interrupted for extended periods of time. Have enough cash and credit for your planned trip to handle emergencies such as man-made or natural disasters that may affect your travel plans. Have a wonderful and careful holiday weekend.

Lakeland's “Get Caught Recycling” program is to encourage increased recycling. It truly “pays” for several Lakeland residents to recycle!

Household addresses are selected in a random drawing. A City representative checks the bins at the houses in the order of the draw. Four households each month that have at least three different types of recycle material receive $50. The winners "caught recycling" are invited to the Lakeland Board of Commissioners meeting the following month for recognition by the Board, and to receive their checks. Items that can be recycled and qualify for the contest are glass, metal cans, aluminum cans, plastics, newspapers, and cardboard boxes broken down to fit inside the recycle bin.

City of Lakeland E-mail out Tuesday, June 29

The City of Lakeland e-mail (@lakelandtn.org) will be be out Tuesday, June 29 and possibly part or all of Wednesday, June 30 for a planned upgrade. E-mail received during this time is supposed to be delayed and we should be able to respond to it on a delayed basis after service is restored.

Other e-mail addresses and the City of Lakeland phone system should not be affected

Consolidation Watch: Valid surveys?

I attended the Thursday, June 17, 2010 meeting of the Metro Charter Commission, the group appointed by Mayor Wharton to develop a Charter for Metropolitan Government. The proposed Charter will be voted on at the November, 2010 elections.

I was surprised at these developments:

1. A representative of "Rebuild Government", a lobbying group for consolidation appeared and presented a "survey" to the Commission as he has done at past meetings.

As with all of Rebuild Government surveys, there was no information on:

-If the questions had been reviewed and determined to be valid (such as neutrally worded etc.)

-No indication of how the survey was taken (random phone survey, visits, self-responses to e-mails etc). A truly random sample is a lot different than an e-mail sent to supporters!

-No information on the number of respondents. (It may have have been five, or 500 for all the information that was presented.)

-No information on the "margin of error" or if there even was a "margin of error" determined. This normally (at least statistically) tells how valid a survey really is.

What really concerned me is that the Metro Commission members, who are responsible for writing Charter that will affect every Shelby County resident for years, accepted the survey without any questions!

One Commissioner even seemed to think that the Metro Commission should ignore an Attorney's Opinion and proceed with a Charter provision based on the survey!

When you hear the Metro Commission and pro consolidation proponents trumpet the "survey results" of Rebuild Government, be sure to ask the questions I noted to determine if the survey is even close to being statistically valid!

2. I was even more surprised to hear the representative of Rebuild Government submit a provision that "he had been asked about", that was accepted by the Metro Charter Commission for the "Charter writing committee" with virtually no discussion.

The document (the survey and the proposed Charter provision) was handed to the Charter Commission at the meeting. Members of the audience had to ask for it.

I do wonder why was this not on the Agenda and yet a motion approved to take action on it? I have always assumed that the Open Meeting Law at least required that an item be on the agenda before action was taken, and it is surprising the documented was handed to the Members at the meeting, when it was obvious the information could have been available well before the meeting and included on the agenda for a full discussion.

BOC Work Session Starting Time Changed

To accommodate the desire of Board members and residents to attend the Partnership Lakeland Candidate Forum (7:00 p.m., Tuesday, June 22, 2010 at the First Baptist Church), the Board of Commissioners Work Session will start at 5:00 p.m.

No action is taken at the Work Session. Action on agenda items will be taken at the Thursday, July 1, Regular Meeting. Mayor Carmichael, Vice Mayor Nicholson, and Commissioners Mark Hartz, Don Barber and Cecil Tompkins encourage all residents to attend the Candidates Forum to help you decide how to vote in the August Primary! Lakeland pictures eligible for "Capature Memphis" book

Lakeland residents are encouraged to upload their favorite pictures of Lakeland for inclusion in a book and related CD of Shelby County pictures.

Although the title says “Capture Memphis”, the program accepts and encourages participation by all Shelby County residents. Essentially, the program encourages all Shelby County residents to upload pictures of Shelby County and then vote on the pictures that will be included in a book (and related CD) on Shelby County.

I encourage Lakeland residents to take your favorite pictures of Lakeland and upload them to www.CaptureMemphis.com and then vote on the best Lakeland pictures to be included in the book.

Consolidation Watch: 2000 Census data to be used for Legislative Districts

Legislative Districts for the proposed "Metro" consolidation government must be based on 2000 Census data according to a report to the Metro Charter Commission.

This means that the Districts for the Metro Government would assume that Lakeland had 6,682 residents (rather than 11,000) and act as if Arlington had 2,560 residents (rather than 9,700). All suburbs would have similar disparities, due to the rapid growth of the suburbs since 2000.

A report to the Metro Charter Commission indicated that the 2000 Census data must be used since it it the last year when all areas of the County were counted at the same time. All districts are required to have as equal representation as possible, which would result in extreme disparities in representation.

The proposed Charter must reflect the 2000 Census data which means that in reality the districts will be be extremely unequal since they will reflect 2000 population rather than the actual 2010 population.

This was only a report to the Metro Charter Commission and no action was taken on the report. Hopefully, the proposed Charter would require immediate redistricting based on the 2010 Census. However, the Lakeland area will be severely underrepresented in the original districts.

ReadyShelby.Org's objective is to prepare Shelby County residents for an emergency, especially to prepare residents to survive for 72 hours on their own until help can arrive. The project includes all of the Shelby County mayors, major corporations and a major foundation that are working together to insure that Shelby County residents can be “READY” for any emergency.

I urge all Lakeland residents to go to ReadyShelby.Org and look at this program, which I consider one of the more important and effective programs I have ever encountered.

Some basics are noted below. Five simple steps to “I’m Ready” are:

• Create a family communication plan … where to meet, who to call, who’s picking up the kids, etc.

• Determine your safe place at home, at work, at church, etc.

• Pack an emergency kit and first aid kit.

• Learn compression-only CPR.

• Participate in free Community Emergency Response Team (CERT) training.

Some major programs associated with ReadyShelby will be announced in the near future but are already posted at www.ReadyShelby.org. All Lakeland (and Shelby County) residents are encouraged to explore ReadyShelby.org and become Ready for any emergency!

This Saturday, Potluck, Dance Lesson at Lakeland Dance

A "Bop" dance lesson from 5:45 p.m. to 6:45 p.m. and a "potluck" supper starting at 7:00 p.m. highlight the River City Bop Club Saturday dance this Saturday, May 22, 2010 at the IH Clubhouse at 4523 Canada Road.

Lakeland residents are especially invited to attend. The dance lesson is free and admission to the dance (and potluck) is $4.00. Adult music is featured and if you don't hear your favorite, ask for it! Many different styles of dance can be danced to the music! Come on out and try it!

Jo Reynolds, President of the River City Bop Club recently sent a check for over $1300 from funds raised at the fund raising dance on March 20. The funds will be used for the continue renovation of the IH Clubhouse. Thanks to Jo and the River City Bop Club for their strong support of the IH Clubhouse and Lakeland!

SHOP LAKELAND DAY SCHEDULED SATURDAY AUGUST 7

“Shop Lakeland Day” is scheduled for Saturday, August 7. The Lakeland Board of Commissioners recently authorized more flexible promotional opportunities for Saturday, August 7 for participating Lakeland businesses. Details are available at Lakeland City Hall and information is being sent to all Lakeland businesses.

Participating Lakeland businesses will offer specials and promotiosn to customers to provide an opportunity for area residents to acquaint them with products and services provided by Lakeland businesses.

The Lakeland Chamber of Commerce and the City of Lakeland are sponsoring the event. Opportunities are still available to participate in the planning of this event and suggestions by businesses and interested persons is welcome!

Consolidation Watch: Proposed Metro Government Unfunded Liabilities for retirement exceed $1,500,000,000

Information distributed at the Metro Charter Commission meeting on Thursday, April 29, 2010 indicated the new Metro Government would assume the following "unfunded liabilities" for retirement:

-Shelby County has a surplus or $26,772,516 in its pension fund and an "unfunded liability" for "Other Post Employment Benefits" of -$257,543,000.

-The City of Memphis has an "unfunded liability" of -$449,527,000 in its pension fund and -$934,240,000 for"Other Post Employment Benefits".

Unfunded liabilities are an accounting figure estimating future liability that is not covered by current assets or revenues. "Other Post Employment Benefits" are mostly for retirement. It is not unusual for government or private businesses to have large "unfunded liabilities" for retirement.

Under the proposed "Metro Government" consolidation, the over $1,383,767,000 in "unfunded liabilities" of the City of Memphis is expected to become the liability of all of Shelby County residents and property owners, in addition to the existing Shelby County unfunded liability of $257,543,000.

Due to the type of retirement system provided Lakeland personnel, the City of Lakeland does not have any similar "unfunded liabilities" for either pensions or "Other Post Employment Benefits".

Stop Litter and Support Lakeland Businesses Who Support Lakeland!

I noticed the Manager of the Lakeland Walgreens, Mark Lehner, and another Walgreens employee out picking up litter on their parking lot early one windy, cool, morning. This was just after receiving an e-mail from a resident concerned about Lakeland businesses that don't pick up litter on their property or take care of their property.

We appreciate the many businesses like the Lakeland Walgreens that put a lot of effort into taking care of their property and supporting Lakeland's efforts at beautification.

The Lakeland Natural Resources Board is starting a beautification program that will include a litter control element.

We urge Lakeland residents to support Lakeland businesses, especially those businesses who make special efforts to support Lakeland.

Lakeland CERT Class rescheduled from April 24 to May 1

CERT Class scheduled for Lakeland April 24 has been rescheduled to May 1, 2010 due to the impending weather

Share the Road! (If not, call 379-7625)

The City has received several complaints about bicycle riders and runners blocking traffic, advising motorists the road is "closed" and making obscene gestures and otherwise threatening motorists, especially in the area of Monroe Road. The City of Lakeland has not received, nor granted, any requests to close this road for a bicycle or running/walking event.

As a bicycle rider and walker myself (I hope a courteous one), I was disturbed at reports of bicycle riders and runners not "sharing the road" in a courteous manner. I see it from the perspective of a bicycle rider, pedestrian, and also as a motorist, and, 99% of the time, I feel all parties are courteous in Lakeland, in fact, I meet both motorists (when I am biking/walking) and bikers (when I am driving) who go out of their way to be courteous and "Share the Road".

However, after receiving three complaints in a short time about the same street, I have to assume there is merit in the complaints.

I discussed this with Steve Shular, of the Shelby County Sheriff Department. He advised me as follows:

-Bicycle riders and pedestrians (runners or walkers) have a right to legally use the road. Generally, bicycle riders and pedestrians are expected to stay in their lanes.

-Under no conditions (other than with a parade permit etc.) is it legal for bicycle riders or pedestrians to block the road, block traffic, or create a hazard. (Riding at a normal speed of the bicycle to the right in your lane is NOT blocking traffic.)

-Obviously anyone threatening, using abusive language or creating a hazard to the other party is not acceptable.

If anyone uses abusive or threatening language or gestures, etc., call the Sheriff Dispatcher at 379-7625. DO NOT try to handle it yourself, but call as soon as possible with your location and follow the instructions of the dispatcher until assistance arrives.

Reminder-Yard Waste must be in bags or containers

Lakeland residents are reminded that, since January 1, 2010, all yard waste must be bagged or in a green container to be picked up by All Star Waste Services as part of the regular pickup routes.

Yard waste that is not in a bag or container (such as limbs) will require a special pickup by calling All Star Waste Services at 901 854-8865 and requesting a special pickup. There is a $25 charge for special pickup of loose yard waste for the first 30 minutes and$10 for each additional five minutes.
Most loose yard waste I have observed can be picked up in 30 minutes. All Star Waste Systems vehicles are equipped with GPS locator's units to insure accuracy in billing. Charges for special pickups are billed directly by All Star Waste Systems.

The change was necessary due to the high cost of collecting loose limbs, which was being paid by all customers, current and future recycling requirements by the State of Tennessee and storm water requirements.

FREE C.E.R.T. (COMMUNITY EMERGENCY RESPONSE TEAM) CLASS

A C.E.R.T. (Community Emergency Response Team) class is scheduled at Lakeland City Hall April 17th and 24^th, 8:00 a.m. to 4:30 p.m.. Both classes must be completed to receive C.E.R.T. certificate/certification. You can find the application on the Lakeland website, www.lakelandtn,gov. or sign up at City Hall. We need at least 20 people to sign up for the course. The C.E.R.T. classes are FREE and will prepare Lakeland and area residents to respond to emergencies. If we don’t fill the class it will be difficult to bring the program back to Lakeland, so be sure to inform your entire neighborhood.

Lakeland Residents have a rare opportunity to receive some quality training this month. The C.E.R.T. TO GO program is a trial program and if attendance is low the program may be canceled. If the program is canceled the only way for the citizens of Lakeland to receive the training is to travel to the EMA facility in Midtown Memphis (free course) or pay to take it from the Bartlett Fire Department.

The long term goal is to build a regular training program here in Lakeland once funds become available. Until that time we must depend on the Memphis/Shelby County program or the Bartlett Fire Department.

Good leadership is key to successful disaster response. A damaging flood, fire, earthquake or other emergency might overwhelm local fire, police, hospital, and city personnel. As a result, your neighborhood response teams might have to treat the injured, rescue those who are trapped and assess the damage to homes, neighborhoods, businesses and schools. C.E.R.T. training will provide you tips on how to organize your neighborhood response team.

If your neighborhood, work place or school doesn’t have an emergency response team, form one now. Local agencies such as Emergency Management and Red Cross can give you helpful information in setting up response teams. Emergency response teams will operate best if they are organized and have good leadership. The Planning Committee can develop goals and objectives before the next emergency.

The committee should give a Block or Team Captain the authority to make decisions after an emergency. It’s important, however, that the Block Captain work with other leaders and delegate assignments and responsibilities, as appropriate. To maintain control, no one person should direct more than 5-7 people. House meetings are a valuable tactic for recruiting volunteers and building a team. Your house meeting will help you identify your leadership team. Building community through house meetings is a critical step towards the President’s ultimate goal, which is to support everyday Americans in a grassroots effort to improve lives and strengthen communities.

Arbor Day 2010 Scheduled

ARBOR DAY 2010

Come celebrate Lakeland’s ninth Arbor Day and help us plant a tree at City Hall Park. We will be offering a free tree care workshop from nationally known forestry experts and will be handing out FREE TREES.

Mayor Carmichael will receive our sixth Tree City Award.

Jacob Brown, our Arbor Day Poster contest winner will be available to personally autograph your copy of the Winning Poster.

The tree planting this year will be in memory of Lew Cornett, who died March 6th. A redbud tree will be added to the memorial tree grove at City Hall Park in his memory. The plaque will not be ready in time for the ceremony but we still want to honor Lew on that day. Staff will install the plaque with his wife, Bobbi, later the following week.
